1. DEFINITIONS
1.1 In these Conditions, the following expressions will have the following meanings:
“We”, “our”, “us” refers to Ladies Who Shop Limited
“You”, “yours” refers to the shopper named on the Booking Form
“Booking Form” the booking form signed by you relating to the Event and which incorporates these terms and conditions
“Event” the shopping event referred to on the Booking Form
“Working Day” any day of the week but excluding Saturday, Sunday and any bank or public holiday in England
2 OUR COMMITMENTS TO YOU
2.1 We will provide the services for the Event as detailed on the Booking Form. We will ensure those services are provided to a reasonable standard in the context of the nature and type of the Event.
2.2 We may occasionally feel it is necessary to vary or substitute items of the services which have been detailed on the Booking Form either on the day of the Event or after you have booked on to the Event. We will only make variations to these services which are due to unforeseen changes in circumstances that make it impractical for us to provide the services as originally described. We will ensure that any substituted or varied items of the services for the Event are of a comparable quality so that your enjoyment of the Event should not be affected.
3 YOUR COMMITMENTS TO US
3.1 In order that all shoppers and guests who participate in the Event are able to fully enjoy their experience with us, we request that you behave in a responsible manner and ensure that any of your guests also behave responsibly.
3.2 If we incur any costs in having to rectify any damage that you cause to the property or belongings of a third party, you may be required to reimburse us for those costs. We would not require any recovery of costs where the damage was the result of a genuine accident.
3.3 You acknowledge that any misbehaviour of either you or your guests will be reasonable grounds for us to refuse to allow you to participate in any further events that we may organise.
4 FINANCIAL ARRANGEMENTS
4.1 We will, after 7 Working Days have elapsed from the date when you returned to us a signed Booking Form, invoice you for the total cost for you and any guests at the fee indicated on the Booking Form.
4.2 You will pay the invoiced amount in full prior to the date of the Event.
4.3 We will be able to refuse to allow you to participate in the Event if payment has not been made in full prior to departure. In exceptional cases we will allow payment to be made on the day of the Event prior to departure but only where you have notified us in advance that you wish to make payment at that point.
5 CANCELLATION
5.1 You have the right to cancel your booking with us by notifying us in writing, either by post, fax or e-mail during the period of 7 Working Days starting from the day after the day on which you returned your Booking Form to us.
5.2 If you cancel your booking with us in the period referred to in condition 5.1 then no fees will be due from you and you will receive a full refund from us of any fees that you may have paid.
5.3 If your Booking Form is received by us less than 7 Working Days prior to the date of the Event you may still cancel your booking with us at any time prior to the Event. If you participate in the Event you will lose your right to cancel your booking and you will be responsible for the fees detailed in the Booking Form.
5.4 You may cancel your booking with us at any time after the period referred to in condition 5.1 has expired but prior to the date of the Event. If you do cancel, we will refund any fees that you may have paid if we are able to find a replacement shopper for the Event or if your cancellation does not materially impact on the total number of shoppers who are due to participate in the Event.
5.5 We may cancel the Event at any time if the demand for the Event is not felt by us to be sufficient or if circumstances occur which make the Event impractical. We will advise you as soon as possible of any cancellation by us and provide a full refund for any fees which you may have paid.
6. LIABILITY
6.1 We will only be liable for any losses that you suffer during the Event due to a breach of our obligations to you or a failure in our duty to you, and where these losses are a reasonably foreseeable consequence of our breach or failure.
6.2 We will not be liable to you:
6.2.1 for any loss or disappointment that you incur which is caused by an event or circumstances beyond our reasonable control;
6.2.2 for any faults, defects or disappointment arising from any of your shopping purchases;
6.2.3 any personal injury or death of you or your guests during the Event unless we have contributed to the cause due to our negligence or breach of our statutory duty to you;
6.2.4 for any loss or damage to your property or personal belongings or the property or personal belongings of your guests unless we have contributed to the loss due to our negligence or breach of our statutory duty to you.
6.3 Whilst our shopping advisers will be available during the Event to provide shopping tips and hints, we cannot accept any responsibility for your shopping choices.
7 INSURANCE
7.1 Whilst we will ensure that suppliers of road transport in the United Kingdom which is used as part of the Event have in place appropriate insurance to cover their statutory liabilities, we recommend that you have in place relevant personal insurance to provide cover for yourself and you belongings for the duration of the Event.
8. GENERAL
8.1 If you have any complaint about us, our services or the Event, you should raise these with us in writing to our address set out on the Booking Form. Please address your complaint to Kathryn Hopkins. We will try to deal with your complaint as soon as we can.
8.2 The provisions of our terms and conditions and the Booking Form can only be enforced by us and you. They do not give any contractual rights or remedies to your guests.
8.3 Our contract with you for the Event which comprises the Booking Form and these terms and conditions is to be subject to English law. The English courts will have the jurisdiction over any disputes that arise between us and you.
